Appeals Policy for The Buhnanuh Club

  • You must follow the procedure outlined below to appeal any content or account moderation decision.

Definitions

In this policy, unless specifically stated otherwise, words defined in the Terms of Service will have the same meanings.

  • "Decision" refers to any action taken by The Buhnanuh Club to:
    • Suspend or deactivate an account
    • Suspend or deactivate content shared through an account
    • Issue a final warning for a violation on an account
    • Restrict account features (e.g., livestreaming capabilities)
    • Suspend, terminate, or restrict the ability to monetize content, including preventing subscriptions or limiting payment acceptance

 

Appeal Procedure

The only way to appeal a decision made by The Buhnanuh Club is by completing and submitting the Deactivation Appeal Form.

 

Required Information for an Appeal

To be considered, the Deactivation Appeal Form must be fully completed and must include the following:

  • The URL or username of the account involved
  • The URL of content subject to the appeal
  • A detailed explanation of why you believe your content or account complies with The Buhnanuh Club’s Terms of Service and Acceptable Use Policy
  • For users in the EU/EEA, if the appeal involves suspected illegal or non-consensual content, please include your reasoning on why you believe the content violates the law

 

Timing of Appeals

Appeals must be submitted within six months of the decision.

 

Review Process

Once we receive a completed appeal, we will:

  1. Review the relevant account information
  2. Consider the details and supporting documents you have provided
  3. May request additional information or documents from you or third parties to help us make an informed decision

Based on this review, we will either:

  • Grant your appeal, reversing the decision and any related actions
  • Grant in part your appeal, where we will reverse some decisions and provide details of the actions taken
  • Deny your appeal, where no decision will be changed

 

No Liability

The Buhnanuh Club is not liable for any interruption of access to your account, including any loss of earnings or subscribers, even if we grant part or all of your appeal.

 

Appeals Team

Our Appeals Team will handle each appeal based on the information provided in a fair, diligent, and non-discriminatory manner.

 

Situations Where a Decision Cannot Be Appealed

This policy does not apply to irreversible decisions, such as a decision to end a livestream.

 

Additional Procedures for EU/EEA Users

As a user in the EU/EEA, you may:

  • File a complaint with a regulatory authority
  • Seek a remedy through a certified third-party out-of-court dispute settlement body or relevant courts in your country of residence

Under the EU Digital Services Act (DSA), out-of-court dispute settlement bodies may apply for eligible disputes. EU member states certify such bodies to handle these disputes.

You also have the option of pursuing judicial redress in a court with appropriate jurisdiction.

If you report or complain about content that you believe is illegal or violates our Terms of Service, we will review your complaint and determine if a violation has occurred.

 

If we conclude that no violation of our Terms of Service has occurred and choose not to take action regarding the content, you may refer the matter to an out-of-court dispute settlement body. If you do so, we will engage with that body in good faith, as required by law.

Please note that The Buhnanuh Club is not bound by the decisions of out-of-court dispute bodies, and may refuse to engage with them if the dispute has already been resolved through a previous decision.
